Stockton Ruling Seen as Key to US Municipal Bankruptcy Options ...

BankruptA federal judge on Monday is expected to rule on whether the city of Stockton, California is eligible for bankruptcy protection, a key milestone in a case likely to set critical precedents for cash-strapped U.S. cities, their employees and their bondholders.

The decision follows a three-day trial last week in which the city argued it had no choice but to file for bankruptcy after the financial meltdown devastated local tax revenues and harsh budget cuts still left the city with a $26 million shortfall.

Municipal bankruptcies have historically been rare, but troubled American cities increasingly see it as an option as they struggle with big debt loads, shrinking tax bases and massive pension and healthcare obligations. The California city of San Bernardino has also filed for bankruptcy, and some expect the city of Detroit, Michigan eventually to surpass Stockton as the biggest U.S. city to file for bankruptcy.

In the Stockton case, attorneys for bond insurers, who could potentially be forced to absorb major losses in a bankruptcy, argued the city could have done more to cut costs and raise revenues. The bondholders, who are not being paid in full under the city?s interim operating plan, have also argued that pension payments made to the California Public Employees Retirement System (Calpers) should be slashed.

Bankruptcy experts expect U.S. Bankruptcy Judge Christopher Klein to find the city eligible for bankruptcy.

Michael Sweet, a lawyer at Fox Rothschild who helps local governments on bankruptcy issues but is not directly involved in the Stockton case, said the city had proven even before last week?s trial that it was truly broke when it filed for bankruptcy protection last June. A municipality must be insolvent to be eligible.

?It will be hard for the judge to conclude that they weren?t insolvent,? Sweet said.

Stockton, a city of 300,000 residents in California?s Central Valley, aims to use the Chapter 9 bankruptcy process to right the city?s finances with a number of drastic measures. The city has already defaulted on some debt and allowed creditors to seize the assets ? including a parking garage and a city building ? and has cut payments to other municipal bondholders.

The city slashed the police department by 25% and cut other departments even more before it filed for bankruptcy. It has moved to eliminate a generous retiree healthcare plan ? a major hit for many former city employees ? but has not challenged pension payments to Calpers.

The retirement fund argues that under state law, pension payments cannot be reduced even in bankruptcy ? an issue that is also front-and-center in the San Bernardino bankruptcy and one that could eventually find its way to the U.S. Supreme Court.

KEEPING TRADITION INTACT

Bondholders in major U.S. municipal bankruptcies have been repaid all of their principal since at least the 1930s ? and Stockton?s creditors don?t want to see that change.

Bond insurers Assured Guaranty Corp, Assured Guaranty Municipal Corp and National Public Finance Guarantee Corp were joined by Wells Fargo Bank, the Franklin California High Yield Municipal Fund and Franklin High Yield Tax-Free Income Fund in contesting Stockton?s bid for bankruptcy eligibility.

Assured?s net exposure to Stockton?s general fund-backed debt is $158 million. A spokesman for National said the MBIA Inc unit?s Stockton-related exposure is $224 million, $89 million of it tied to the city?s general fund. Franklin Advisers Inc, holds $35 million of uninsured Stockton lease revenue bonds.

Lawyers for the creditors argued to U.S. Bankruptcy Judge Christopher Klein that Stockton did not meet requirements to be eligible for bankruptcy court protection.

They claimed Stockton officials did not do enough to mend the city?s finances and acted in bad faith by exempting the city?s largest creditor ? Calpers ? from concessions in a mandatory pre-bankruptcy mediation.

They also said Stockton is not really broke, and that city officials are conflicted because they have accounts with the pension fund.

James Spiotto, a municipal law specialist at the Chapman and Cutler law firm, said that attack fell flat, noting that a finding of bad faith is a high bar.

Sunken Apollo rocket engines raised

Two long-lost engines from Apollo-era rockets have been hauled from a depth of more than 4km in the Atlantic Ocean.

The F-1 engines are from the first stage of a Saturn rocket, which were used throughout the Apollo programme - one of which launched men to the Moon.

A number of engines were first found nearly a year ago by Bezos Expeditions, run by Amazon founder Jeff Bezos.

The two recovered engines will now be restored and put on public display.

The F-1 was a workhorse engine for the US space agency Nasa as the most powerful single-chamber liquid-fuelled engine ever developed. Five F-1 engines sat at the bottom of the Saturn-V rockets used throughout the Apollo programme.

After three weeks at sea, the Bezos Expeditions team recovered two such engines using remotely-operated vehicles.

Because the engines' serial numbers are partially missing, it remains unclear which Apollo mission they are from - that may become clearer during restoration.

Mr Bezos is a long-time space enthusiast and also leads Blue Origin, one of a number of private spaceflight firms aiming to drastically reduce the costs of spaceflight.

"We've seen an underwater wonderland - an incredible sculpture garden of twisted F-1 engines that tells the story of a fiery and violent end, one that serves testament to the Apollo program," Mr Bezos wrote in a blog post from the ship Seabed Worker, now on its way back to Cape Canaveral.

"Each piece we bring on deck conjures for me the thousands of engineers who worked together back then to do what for all time had been thought surely impossible."

Nasa administrator Charles Bolden released a statement congratulating the team, saying: "This is a historic find and I congratulate the team for its determination and perseverance in the recovery of these important artefacts of our first efforts to send humans beyond Earth orbit."

Biden and Bloomberg urge Congress to have ?courage? on gun laws

In an appearance at City Hall, Biden and Bloomberg were joined by family members of some of those killed in December?s mass shootings at Sandy Hook Elementary School in Newtown, Conn., in urging Congress to immediately pass legislation including stricter rules on background checks and a ban on assault weapons, which they both described as ?weapons of war.?

?It?s time for the political establishment to show the courage that your daughter showed,? Biden told the father of Lauren Rousseau, a Sandy Hook teacher killed while trying to protect her students.

The vice president signaled the White House wasn?t giving up on its push to ban assault weapons, insisting ?this is not about anybody?s constitutional right to own a weapon.?

He added, ?For all of those who say we can?t and shouldn?t ban assault weapons, for all those who say the politics is just too hard, how can they say that? When you take a look at those 20 beautiful babies and what happened to them? And those six teachers and administrators? Think about Newtown. Think about Newtown."

Biden's comments came just days after Senate Democrats dropped an assault weapons ban from their proposed package of gun reforms, arguing it would kill any chance of passing any new gun laws.

Bloomberg, who has emerged as one of the leading voices in favor of new gun-control laws in the aftermath of Newtown, called on lawmakers to have ?courage.? He argued that if new gun-control laws don?t pass this year, at least 12,000 people are likely to die from gun violence in 2013 alone, based on past statistics.

?In the end, what Congress has to decide is whether it?s politically popular or is it the right thing to do,? Bloomberg said.

The mayor insisted ?there is no debate? among the majority of Americans about the need for tougher background checks and bans on sales of high-capacity magazines and assault rifles.

At one point, Biden praised Bloomberg for his advocacy on guns, saying ?no support has been more consequential than the support coming from Mayor Bloomberg.?

After Biden and Bloomberg spoke, Neil Heslin, whose 6-year-old son Jesse was killed at Newtown, approached the podium and issued an emotional plea for members of Congress to pass new gun laws.

?I'm really ashamed to see that Congress doesn?t have the guts to make a change,? Heslin said, speaking in a somber tone that was barely audible. ?I never thought my son would be a victim. I wish it upon nobody what I have had to go through.?

Weak Oracle sales, Cyprus fears weigh on US shares

Stocks fell on Wall Street Thursday as Oracle's weak sales results weighed down big U.S. technology companies. Traders worried about Cyprus running out of time to avoid bankruptcy.

Major indexes followed European markets lower at the open. The Dow Jones industrial average fell as much as 98 points. By mid-day they had pared the losses. Shortly before noon eastern time, the Dow Jones industrial average and the Standard & Poor's 500 index were down about 0.3 percent. The Nasdaq composite index, which is heavily weighted toward tech shares, declined more than 0.6 percent.

All three indexes felt the drag from technology stocks after Oracle reported an unexpected decline in sales in its fiscal third quarter. Oracle was the biggest decliner in the S&P 500 index; Juniper networks also fell steeply. The S&P 500 fell five points to 1,553.

The Dow dropped 36 points to 14,476. Cisco was the Dow's biggest loser, followed by IBM, H-P and Intel.

The Nasdaq fell 20 points to 3,234.

Still, stocks remain near multi-year highs reached in recent weeks after a rally powered by optimism about the U.S. economy and the Federal Reserve's easy-money policies. The Dow is up 3 percent this month. The S&P 500 has gained 2.6 percent in March, and is 11 points from an all-time high set in October 2007.

The recent gains leave the market vulnerable to any negative news about corporate earnings, the economy or Europe, said Uri Landesman, president of the hedge fund Platinum Partners.

"It's priced like everything's going to be wonderful," Landesman said. He said stocks aren't likely to go higher in the next few weeks. They may drop another 3 percent before making another run at the S&P record sometime next month.

U.S. stocks are benefiting from money flowing out of other investments like bonds and overseas stocks, he added.

European markets closed sharply lower Thursday. The main indexes in Paris and Frankfurt fell a percentage point or more on fear that the crisis in Cyprus will intensify. The European Central Bank has threatened to end emergency support of the nation's banks next week unless leaders can secure more funding.

Cyprus must raise about $7.5 billion in the next four days to avoid bankruptcy. Several plans have failed, including a proposal to tax deposits held by the nation's banks. If the Mediterranean banking haven is unable to secure a bailout, its banks will fail and it could be forced to leave the euro currency.

In the U.S., the yield on the 10-year Treasury note fell to 1.94 percent from 1.96 percent earlier as demand increased for ultra-safe investments.

The U.S. job and housing markets continue to improve gradually, according to economic reports released Thursday morning. The Labor Department said the number of people claiming new unemployment benefits last week was roughly flat near a five-year low. Sales of existing homes rose in February to a three-year high, according to the National Association of Realtors.

In the tumbling tech sector, Oracle fell $2.98, or 8 percent, to $32.79. Juniper dropped 56 cents, or 3 percent, to $18.75. Cisco fell 75 cents, or 3 percent, to $20.92. IBM declined $3.45, or 2 percent, to $211.61. And Intel was off 11 cents, less than 1 percent, at $21.07.

Outside of technology, here are some stocks making big moves:

? Struggling drug company AstraZeneca jumped after saying it would cut 2,300 more jobs worldwide and overhaul its research operations. That brings to 11,000 the number of job cuts announced in the past 13 months. Shares rose $1.43, or 3 percent, to $47.61.

? Publisher Scholastic Corp. plunged after shrinking demand for its best-selling "The Hunger Games" books forced it to cut its guidance for the year. The company's fiscal third-quarter loss nearly doubled. Shares fell $4.48, or 14 percent, to $26.59.

? Movado Group Inc. dropped after the luxury watchmaker said its fiscal fourth-quarter net income fell 26 percent. The stock fell $1.96, or 5 percent, to $35.16.

The key to a calmer existence, experts say, is finding bite-size, everyday solutions for stressors and releasing what we can, be it physical or psychological clutter. "When you start to let go, your life lightens up because you have less to think about and less to maintain," says Geralin Thomas, a professional organizer in Cary, N.C. "You finally feel in control." The payoffs don't end there -- you can sharpen your focus and even lose weight, too. These are the strategies that will ease your load and let you enjoy life a lot more.

As we juggle it all, we're often fueled by an I-can-do-it! sense of pride. But we might be deluding ourselves, suggests a study in the Journal of Communication that found that people misperceive the emotional high they get from multitasking as productivity. And we're not even as good at it as we may think. Another study, published in Psychological Science, revealed that women's ability to keep track of several tasks at once dipped significantly during ovulation, when estrogen levels are high (and can mess with brain function).

Technology sometimes hampers us more than it helps, adds Laura Vanderkam, author of 168 Hours: You Have More Time Than You Think. "Time speeds by when you're on your smartphone e-mailing," she says, "even if you're really not doing anything important."

What To Do:

  • Suss Out Time Sucks. For one day, every couple of hours note down exactly what you just did, including things like "Read Facebook updates for a half-hour" or "Scanned catalogs for 15 minutes after opening mail," says Vanderkam. "You start to see the time periods that you're not using as well as you'd like."
  • Stop The Auto-Yes. "Everyone lives in an optimistic world and thinks that if we say yes we will find the time, but the truth is we are in denial," says Julie Morgenstern, one of the top organization and productivity experts in the country. Instead, experiment with saying, "Let me think about how I can do that," says Morgenstern. "This way you can step back and evaluate if you really can do what is being asked."
  • Have A Plan. "Most people's to-do lists actually create fatigue, because they don't clarify how, exactly, they are going to handle Mom's birthday, so tasks feel bigger than they are," says David Allen, a productivity expert and author of the best seller Getting Things Done. Take a second to jot down how you'll tackle something. Feel better already?
  • Just Do It. Allen regularly tells clients to follow his Two-Minute Rule: If something can be done in two minutes, go ahead and get it done. Explains Allen, "It will take you longer to look at it again than it would take to finish it the first time you think of it."
  • Reconsider Rewards. Carefully examine your commitments, says Morgenstern, and decide which ones energize you -- and which deplete you. For the tasks that send your misery Geiger counter off the charts, pinpoint whatever reward you get from them and find a better way of scoring it. One client of Morgenstern's wasn't really enjoying volunteering for the PTA because it took time away from her kids, but she kept at it because she thought it showed her children she considered school important. Ultimately, she switched over to running the occasional fun class activity and giving her kids more hands-on help with homework. "These things took less time," Morgenstern notes, "and she and her family got more out of them."

Dusting, mopping, vacuuming: That's easy. Getting rid of all the junk you have to dust, mop and vacuum around? Not so much. "Giving things up is tough because it's not so clear-cut when they're no longer useful," says Morgenstern, author of Shed Your Stuff, Change Your Life. You don't stop wearing jeggings on a Tuesday at 4 p.m.; you just gradually stop doing so, even as they languish on a hanger.

The thing is, those pile-ups of possessions can create anxiety; a study at UCLA found that just looking at clutter elevated women's stress hormones (although, no surprise, the men's cortisol levels remained unchanged). Motivation to get going on cleaning house: You may look better, too. As Geralin Thomas points out, "One big change I see in clients who have de-cluttered is weight loss. Once they have shaped their environment, they're ready to shape up themselves."

What To Do:

  • Think Small. "We know from research that little acts of neatness cascade into larger acts of organization," says Christine Carter, Ph.D., a sociologist at UC Berkeley's Greater Good Science Center. Forget about organizing the entire kitchen; focus on, say, the plastic containers taking over your cabinets. "With random de-cluttering, there's always more that you can do," notes Thomas. "When one category is tackled, there's definitely an end point."
  • Be A Regular. Perhaps you dedicate, say, 10 minutes a weekday to an organizing project. Or you commit to doing a couple of hours for a few weekends in a row. The point is, be consistent and attentive; turn off your cell phone and schedule child care. Thomas does a weekly "Trash Eve" de-clutter: "The garbage in my neighborhood is picked up on Wednesdays, which makes Tuesdays the night I make an easy supper and clear the decks!"
  • Decide What's Treasure And What's Toss-Able. Ask yourself just one question before you start purging any collection of stuff, recommends Morgenstern: "If everything was stolen, what pieces would I go out and buy the very next day?" There you go -- the costume jewelry, canned goods and linens you truly want and need.
  • Pre-Arrange Pickups. About 40 percent of people who purge never manage to get the stuff out of their homes, per a poll of 23,000 people on Morgenstern's website. Avoid becoming a hoarder statistic by scheduling a pickup before you start to clean your house. Try salvationarmyusa.org, goodwill.org or excess access.org, a not-for-profit that connects people with local schools and charities in need of specific goods.

It's not just that we have a lot to keep track of -- it's our DIY mentality, says Orit Avni-Barron, M.D., director of Women's Mental Health at Brigham and Women's Hospital in Boston. "I hear women say, 'My husband is so great, he helps me,'" as if our partners are our sous chefs instead of co-cooks. Another issue: Women worry twice as much as men, research shows. "Worrying impairs concentration and memory," says Robert Leahy, Ph.D., director of the American Institute for Cognitive Therapy in New York City. "You can't tend to the present and worry about the future at the same time. It's overwhelming."

What To Do:

  • Pop Annoying Thought Bubbles. Psychologists talk of the Zeigarnik effect, named after a Russian shrink who realized that a waiter could more easily recall incomplete orders than served ones. The follow-up study showed that people are 90 percent more likely to remember undone tasks than those they completed. "Tell your brain when you'll get a task done," says Carter. "It kills the worry loop."
  • Control What's Possible. "When we don't know how something will work out, we worry to get certainty," says Leahy. Yet one study at Penn State University found that 85 percent of things people fretted about had neutral or positive outcomes. To quell anxiety, throw yourself into what you can accomplish -- say, writing the introduction to the PowerPoint document instead of ruminating on the presentation. "You'll feel good about the present and put other thoughts on pause," says Leahy.
  • Be Hands-On. Weed, knead dough, do a craft, says Gayatri Devi, M.D., associate professor of neurology at New York University. "When you think about something tangible, you stop thinking about the theoretical."
  • Grade Perfection On A Curve. "We have reached a tipping point in perfection. People are realizing we can't do it all at the level that we used to," says Morgenstern. That means you, sister! Start with the obvious: Divvy up more responsibilities with your partner, even if he does them differently. And try Morgenstern's Minimum, Moderate, Maximum strategy: Decide what level of effort you can give tasks (and get away with). As she says, "You may be surprised to find that everything works out OK."

The philanthropic campaign kicked off The Goddard School's 25th anniversary celebration.

Oil cuts losses as Cyprus worries ease

NEW YORK (AP) ? The price of oil reversed sharp early losses Monday as nervousness over a bailout plan in Cyprus abated.

By early afternoon in New York, benchmark oil for April delivery was down just 3 cents to $93.42 a barrel. It had dropped as low as $91.76.

Traders initially worried about possible fallout from a plan to pay for a bailout for cash-strapped Cyprus by slapping a tax on deposits in the country's banks. Some bank customers withdrew as much of their cash as they could and the fear was the panic could spread to other countries and prompt capital flight from weaker EU economies.

Stock markets in Asia and Europe fell sharply. But as U.S. markets recovered from an early decline, oil started to rise.

Natural gas rose again, building on a monthlong run that has seen the price jump 23 percent. Futures gained 3 cents to $3.91 per 1,000 cubic feet.

At the gas pump, the average price for a gallon of gas held steady at $3.69. That's down about 15 cents from a year earlier.

Brent crude, used to price many kinds of oil imported by U.S. refineries, was down 46 cents to $109.36 per barrel on the ICE Futures exchange in London.

In other energy futures trading on the Nymex:

? Wholesale gasoline lost 2 cents to $3.14 a gallon.

? Heating oil was unchanged at $2.94 a gallon.

Experiments find strongest shapes with 3-D printing

Mar. 18, 2013 ? Prof. Heinrich Jaeger's research group examines materials and phenomena that appear simple at the surface, but which reveal tremendous complexity upon close examination. One such phenomenon is jamming, in which aggregates of randomly placed particles, including spheres or more complicated shapes, or even molecules, transition from fluid-like to solid-like behavior.

Jamming lends itself to soft robotics, in addition to other applications as explored in a workshop at the University of Chicago last October. In recent computer simulations and experiments, Jaeger, the William J. Friedman & Alicia Townsend Professor in Physics, and graduate student Marc Miskin investigate another aspect of jamming. They analyzed how the properties of a jammed material can be tuned by changing the shape of the constituent particles. Their results on "Adapting granular materials through artificial evolution" appeared Jan. 20 as an Advance Online Publication in Nature Materials.

Miskin and Jaeger addressed a daunting question in their research: Given a design goal for the jammed aggregate, for example to have it as stiff or as soft as possible in response to an applied force, what particle shape will best produce the desired outcome? For this complex optimization problem, they faced an infinite variety of shapes to choose from. So Miskin employed a computer algorithm -- referred to as an "evolutionary optimization" to answer this question.

The computer designed particles by starting from a random shape, and then iteratively altered its configuration, at each stage performing a series of simulations that tested how close the performance approximated the stated goal. Once an optimal shape was identified, Miskin then manufactured a large number of copies with the lab's 3D printer for testing in a vise-like squeezing apparatus to verify his algorithm's predictions.

During each of my pregnancies after my first, I have had a toddler in the mix. When my second was born, my oldest was only 22 months old.? When my third was born, my second was only 2 1/2.? This time around, I'll have a 3 year old when the baby arrives. It can definitely be exhausting chasing a precocious toddler while waddling like a duck, but it also provides a wonderful opportunity to watch a sense of wonder and discovery come alive in a small child as they watch and become curious about Mommy's growing belly.
We've always been very open with our children when we are expecting a new baby.? They know very soon after we know.? It's just news that we have a hard time keeping to ourselves and they are always first in line to hear the good news.? We talk about the coming of the new sibling, talk about memories of the other children when they were infants, and just begin to lay the ground work of preparing them for an addition to our family.

It can be difficult for the young ones to go from being the baby

to being not-quite-the-baby anymore (let's face it, toddlers are still babies themselves!).


Sometimes they also just can't process what Mommy's growing middle really means.? A few days ago, Lydia asked me, "Is there a baby in your belly?"

"Yes, honey.? There is a baby in there!"

"Mommy, are there two more babies in here?" (and she pointed to two other, ahem, growing areas on my torso.)

I had to chuckle.? The workings of a child's mind are often amusing. :)

They wonder, "Will Mommy still cuddle me?"

"Will she still ...

"Read to me?"?

"Play with me?

"Will she still love me?"


Oh, how we have to be very careful in the midst of the sleep deprivation, aches and pains, and nausea to not push our little ones to the side.? Because now, before baby's arrival will lay the groundwork for how they will feel after.? If throughout the pregnancy, Mommy has become more distant and more preoccupied AND your toddler associates those things with the "baby in Mommy's belly," then there is a good chance that they will feel resentful of that baby when it's taking up even MORE of Mommy's time outside of her belly!

It's always an adjustment for everyone in the family when another member joins, but that adjustment doesn't have to be a painful one. Include your toddler in talk about baby, let them help you fold the baby clothes in preparation, let them feel your belly when baby kicks, and tell them how special it is to be a big brother or sister.? Cuddle them, squeeze them, tickle them, and (if it is still physically possible) get down in the floor and play with them (even if you need help getting back up!).? Don't let them ever think that they are losing their special place in Mommy's heart just because they aren't the "baby" any longer.


Time is fleeting.? They are only little once, and if you are like me, this becomes even more obvious when a new baby comes.? The older ones, no matter how young, looks so big compared to an infant.? It's enough to make a hormonal Mama need some tissues.? Don't miss out on this time to include your toddlers with your pregnancy.? Even if they don't fully understand why things are changing, they will notice how.? Make it count.

(AP) ? North Korea's nuclear test last month wasn't just a show of defiance and national pride; it also serves as advertising. The target audience, analysts say, is anyone in the world looking to buy nuclear material.

Though Pyongyang has threatened to launch nuclear strikes on the U.S., the most immediate threat posed by its nuclear technology may be North Korea's willingness to sell it to nations that Washington sees as sponsors of terrorism. The fear of such sales was highlighted this week, when Japan confirmed that cargo seized last year and believed to be from North Korea contained material that could be used to make nuclear centrifuges, which are crucial to enriching uranium into bomb fuel.

The dangerous message North Korea is sending, according to Graham Allison, a nuclear expert at the Harvard Kennedy School: "Nukes are for sale."

North Korea launched a long-range rocket in December, which the U.N. called a cover for a banned test of ballistic missile technology. On Feb. 12, it conducted its third underground nuclear test, which got Pyongyang new U.N. sanctions.

Outside nuclear specialists believe North Korea has enough nuclear material for several crude bombs, but they have yet to see proof that Pyongyang can build a warhead small enough to mount on a missile. The North, however, may be able to help other countries develop nuclear expertise right now, as it is believed to have done in the past.

"There's a growing technical capability and confidence to sell weapons and technology abroad, without fear of reprisal, and that lack of fear comes from (their) growing nuclear capabilities," Joel Wit, a former U.S. State Department official, said at a recent nuclear conference in Seoul.

Pyongyang says it needs nuclear weapons because of what it calls a hostile U.S. policy aimed at invading the North. The U.S., South Korea and others say North Korean brinksmanship meant to win aid and other concessions is the real motive. Even China, North Korea's most important ally, opposes its neighbor's nuclear ambitions.

North Korean nuclear sales earn the impoverished country money that can be pumped back into weapons development, analyst Shin Beomchul at the South Korean-run Korea Institute for Defense Analyses in Seoul said Tuesday.

Its growing capabilities could make North Korea more attractive to buyers, especially if it is determined that highly enriched uranium was used in last month's test.

Proliferation worries have ramped up since late 2010, when North Korea unveiled a long-suspected uranium enrichment operation. North Korea's first two nuclear tests, in 2006 and 2009, were suspected to be fueled by its limited plutonium stockpile. A crude uranium bomb is easier to produce than one made with plutonium, and uranium production is easier to conceal.

Little is known about North Korea's uranium program, but Washington and others are keenly interested in whether it is producing highly enriched uranium for bombs and whether uranium was used in the third test ? two things suspected, but not yet confirmed, by outsiders.

A nuclear test using highly enriched uranium "would announce to the world ? including potential buyers ? that North Korea is now operating a new, undiscovered production line for weapons-usable material," Allison, the Harvard nuclear specialist, wrote in a New York Times op-ed after the North's test.

U.S. officials have hinted that retaliation would follow should Washington discover North Korean cooperation behind any atomic attack on an American city or U.S. ally.

Pyongyang's nuclear transfers and any use of weapons of mass destruction "would be considered a grave threat to the United States and our allies, and we will hold North Korea fully accountable for the consequences," President Barack Obama's national security adviser, Tom Donilon, said last week.

U.S. officials have long tracked North Korean dealings in nuclear and weapons technology. Sanctions have cut down on missile sales, but Iran and Syria, two countries seen by Washington as rogue actors, may continue to be customers.

In November, the head of Iran's Atomic Energy Organization proposed observing North Korea's nuclear test, the Japanese news agency Kyodo reported, citing an unidentified Western diplomatic source privy to Pyongyang-Tehran ties.

North Korea is believed to have helped Syria build what senior U.S. intelligence officials called a secret nuclear reactor meant to produce plutonium. In 2007, Israeli jets bombed the structure in a remote Syrian desert.

Japan's government said Monday that it has determined that a shipment believed to have originated in North Korea violated U.N. sanctions because it contained material that could be used to make nuclear centrifuges.

The shipment of an aluminum alloy was seized from a Singaporean-flagged ship transiting Tokyo last August. The ship was reportedly bound for Myanmar from the Chinese port of Dalian, although Japanese government officials didn't confirm Myanmar as the destination.

Japan's chief government spokesman, Yoshihide Suga, said officials searched the ship because they believed it carried North Korean cargo. News reports said the United States tipped off Japan. Suga said officials had determined in subsequent analyses that the rods were made of an alloy that suggests they were intended for use in a nuclear centrifuge.

Suga said the seizure was the first to be conducted under a law Japan passed in 2010 to clamp down on the movement of materials that could be used for nuclear weapons development being brought into, or exported from, North Korea.

The murkiness of the clandestine nuclear trade is a major worry. It's difficult to know how a buyer would use atomic material or know-how, or where material could end up after being sold.

"The terrorist threat of an improvised nuclear device delivered anonymously and unconventionally by a boat or a truck across our long and unprotected borders is one against which we have no certain deterrent or defensive response," Robert Gallucci, a former senior U.S. diplomat who negotiated a U.S.-North Korea nuclear deal used to defuse a nuclear crisis in the 1990s, said late last month in Seoul.

"For Americans, this threat is far greater than the unlikely threat that may someday be posed by North Korean nuclear weapons delivered by a ballistic missile," he said.

RNC to spend $10 million to reach minorities

WASHINGTON (AP) ? Reeling from back-to-back presidential losses and struggling to cope with the country's changing racial and ethnic makeup, the Republican National Committee plans to spend $10 million this year to send hundreds of party workers into Hispanic, black and Asian communities to promote its brand among voters who overwhelmingly supported Democrats in 2012.

Committee chairman Reince Priebus on Sunday also proposed shortening the presidential nominating calendar in 2016 and limiting the number of primary-season debates to avoid the self-inflicted damage from inside-party squabbling on the eventual nominee. Priebus' top-to-bottom changes include picking the moderators for the debates and then crowning the nominee as early as June so he or she could begin a general election campaign as quickly as possible.

"Mitt Romney was a sitting duck for two months over the summer," Priebus said of the 2012 GOP nominee.

To help his party ahead of the 2016 contest already in its earliest stages, Priebus said he would be hiring new staffers to build the GOP among voters in the states.

"It will include hundreds of people ? paid ? across the country, from coast-to-coast, in Hispanic, African American, Asian communities, talking about our party, talking about our brand, talking about what we believe in, going to community events, going to swearing-in ceremonies, being a part of the community on an ongoing basis, paid for by the Republican National Committee, to make the case for our party and our candidates," Priebus said.

That move was part of the recommendations included in a monthslong look at what went wrong in 2012. Priebus tapped a handful of respected party leaders to examine how the GOP could better talk with voters, raise money from donors and learn from Democrats' tactics. Priebus also asked the group to examine how they could work with independent groups such as super political action committees.

Ari Fleischer, White House press secretary under former president George W. Bush, and Sally Bradshaw, a veteran strategist and top adviser to former Florida Gov. Jeb Bush, were among those leading the inquiry. Republican National Committeeman Henry Barbour, a GOP strategist and nephew of former Mississippi Gov. Haley Barbour, was also part of the group. RNC members Zori Fonalledas of Puerto Rico and Glenn McCall of South Carolina rounded out the five-person committee that listened to Republicans' ideas and frustrations.

Those leaders heard from 50,000 rank-and-file members about how to respond to the nation's shifting demographics.

Priebus planned a full-scale rollout of their recommendations Monday, although the proposals are far from a done deal. They would have to win the approval of the 168-member Republican National Committee and then each state's election chief would have to abide by the party's proposed calendar or face consequences, such as losing voting delegates to the nominating convention. The states previously have ignored such penalties.

Priebus said the party review recommended downplaying its internal divisions among candidates, which forced Romney to take more conservative positions on issues such as immigration during his quest to capture the party's nomination. In all, Priebus counted 23 debates among his party's crowded field of contenders, and there were a handful of other events ? including a Newt Gingrich-Herman Cain faceoff in Texas ? that distracted from their main task of defeating Obama.

"Our primary process was way too long... I think we had way too many debates with our candidates slicing and dicing each other," Priebus said, adding that under his proposal the party would pick the networks that would host the debates and journalists who would question the candidates.

"I would limit the debate to a reasonable amount, maybe seven or eight. But not 23. It's ridiculous," Priebus said. "While we were playing footsy debating each other 23 times, what was the other side doing? ... They were actually getting the job done."

Exit polls indicated Obama carried female, black, Hispanic and Asian voting blocs. He also won among voters under the age of 45 and those who lived in mid- to large-sized cities.

That spells troubles for the GOP in a nation that is increasingly diverse. The latest census data and polling from The Associated Press suggest non-Hispanic whites will lose their majority in the next generation, somewhere around the year 2043.

In 2010's elections, Republicans enjoyed the biggest midterm gains since 1938 and became the majority party in the U.S. House. Yet two years later, Democrats captured the biggest prize in American politics, the presidency, and picked up seats in both of Congress' chambers. Despite solid fundraising from the party and quick work from Romney after he won the nomination, the GOP couldn't overcome Obama's four-year head start and on-the-ground organization.

"We have become a party that parachutes into communities four months before an election," Priebus said. "The Obama campaign lived in these communities for years."

Burger King Turkey Burger Rolling Out On Limited-Time Spring Menu

NEW YORK -- If you think a Whopper's too indulgent but are sick of chicken sandwiches, Burger King is offering a turkey burger for the first time.

The Miami-based company is rolling out the new sandwich this week as part of its limited-time offers for spring, marking the latest fast-food effort to cater to health-conscious diners. Last week, McDonald's said it plans to offer a lower-calorie version of its Egg McMuffin made with egg whites. The Oak Brook, Ill.-based chain said the egg whites will be available for any other breakfast sandwich on its menu as well.

McDonald's and Wendy's said they have no records indicating they ever offered a turkey burger, meaning Burger King would be the biggest fast-food chain to do so. But it's not the first. Sister chains Carl's Jr. and Hardee's launched a trio of turkey burgers as limited-time offers in late 2010; they were so popular that they're now a permanent part of the menus.

"Turkey burgers as a category is growing pretty rapidly in the restaurant space," said Eric Hirschhorn, who heads global innovation for Burger King.

As with Carl's Jr. and Hardee's, Burger King said its turkey burger could be added to the permanent lineup if sales are strong enough.

Carl's Jr. and Hardee's introduced turkey burgers in response to consumers in their 20s and 30s, who are more mindful about what they're eating than past generations, said Brad Haley, chief marketing officer for CKE Restaurants, the parent company of the chains. At the same time, he noted that the turkey burgers ? which come with toppings like guacamole and pepperjack cheese_ are successful because they're still seen as indulgent and filling. In terms of nutritional content, he said the key was just to keep them under 500 calories.

Showing that the healthy glow isn't strictly about calories, Burger King's turkey burger clocks in at 530 calories, compared with 470 calories for its grilled chicken sandwich. A regular Whopper is 630 calories.

Burger King's ability to charbroil its turkey burgers may play an important role in whether they're successful. That's what helped the turkey burgers at Carl's and Hardee's do so well, Haley said. When cooked on a flat-top griddle, Haley said turkey burgers can end up having "that refrigerator flavor" that makes them taste gamey.

"If you charbroil them, that doesn't happen," Haley said. "It has a nice, fresh, clean turkey meat flavor."

Although beef prices have been climbing and pressuring restaurant chains, Haley noted that chicken and turkey remain more expensive because the supply chains are still far smaller than for beef. That means turkey burgers at Carl's and Hardee's are more expensive than beef burgers of comparable size.

At Burger King, the suggested price for the new turkey burger is $3.99, compared with $4.29 for its new Chipotle Whopper, which is also being introduced as part of the spring menu.

That menu will also tout a veggie burger, although the only difference from the chain's current veggie burger is that the new one has red onions.

For those who want something more indulgent, Burger King is also offering a Bacon Cheddar Stuffed Burger, which includes a ground beef patty stuffed with smoked bacon and cheese.

It's also offering loaded tater tots stuffed with bacon and sweet onions, a pina colada smoothie, "Donut Holes" and a trio of iced teas.

Two killed in race car crash in northern California

(Reuters) - A race car struck and killed a teenage boy and a man at a northern California speedway during warm-up laps on Saturday, and authorities are investigating what led to the fatal mishap, a sheriff's official said.

The 14-year-old boy and 68-year-old man were standing in the maintenance pit area alongside the dirt track of a sprint-car race at Marysville Raceway Park, about 100 miles northeast of San Francisco, said Yuba County Sheriff's Captain Ron Johnson.

"One of the cars left the track and drove into the pit area," Johnson said, adding that it remained unclear whether the driver exited the track because he was done with his warm-up or lost control of his car due to mechanical problems.

The car ended up striking the teenager and the man who were "standing basically next to each other," Johnson said.

The man died at the scene and the teenager was pronounced dead at a local hospital, Johnson said. Their names have not been released.

A half-dozen racers were performing their warm-up laps at the time of the incident, police said.

The two victims were "both legitimately in the pit area (and) were associated with race-driving teams," Johnson said.

Neither the driver nor anyone else was injured, police said.

The dirt-track race was scheduled as the first round of this year's California Sprint Car Civil War Series, according to a statement from race organizers sent out before the event.

The compact, high-horsepower cars in the racing series are equipped with a metal wing mounted on top the roll cage. Drivers compete for thousands of dollars in prize money, the statement said.

Marysville Raceway Park said in a recorded phone message that the Saturday evening races had been canceled. Event organizers could not be reached for comment.

Last month more than 30 NASCAR fans were injured at the Daytona International Speedway in Florida in a multi-car accident in the last lap of the Nationwide Series race a day before the Daytona 500.

(AP) ? UFC welterweight champion Georges St-Pierre manhandled Nick Diaz for five rounds en route to a lopsided unanimous decision at UFC 158 on Saturday night.

St-Pierre (24-2) pitched a shutout, winning 50-45 on all three judges' cards.

"Nick Diaz is a good guy," said the champion, looking to end the bad blood between the two.

Diaz, who said he was flat after a 13-month layoff, thanked St-Pierre "for giving him the credit I think I deserve."

Diaz came to the fight with a chip on his shoulder and plenty of attitude. He leaves with a loss and lumps on his face, although he showed the champion respect after the fight.

As expected, St-Pierre used his wrestling to control the chirpy challenger, rag-dolling him at times and bullying him on the ground. But he also used his jab and kicks to pick apart the challenger on his feet.

A calm, calculating St-Pierre won almost every battle during the fight without putting himself in harm's way. Diaz (27-8-0 with one no contest) never quit, but showed less of his trademark trash-talking. He had his hands full.

The main event had been rife with animosity, with Diaz showing St-Pierre little respect. The normally calm champion was red-hot coming into the fight, saying he wanted to "retire" Diaz.

He may have done it. Diaz said his fighting days may be over.

"I think I'm done with this mixed martial arts," he said.

In the lead up to the fight, Diaz skipped a public workout, then put on a strange one-man show at the pre-fight news conference that managed to befuddle and antagonize St-Pierre.

"I never took it personally," the champion said after the fight.

The antagonism continued right up to the fight with fellow fighter Jake Shields, a member of the Diaz entourage, complaining about St-Pierre's hand wraps.

"I checked GSP's glove and the wrap looked shady," Shields, beaten by GSP at UFC 129, tweeted before the fight.

UFC President Dana White said Shields had OK'd the wrap, only to have another member of Diaz's camp complain later.

The 31-year-old from Montreal was looking for his eighth straight successful title defense since winning his 170-pound championship back from Matt Serra at UFC 83 in April 2008. Only middleweight champion Anderson Silva has more title defenses (10).

The welterweight contenders' picture grew clearer earlier in the main card as Jonny Hendricks (15-1) won a unanimous 29-28 decision over Carlos Condit (28-7) in a wild co-main event that left both men blooded, and with the respect of their boss.

"These boys are holding nothing back," tweeted an appreciative White.

Hendricks, who said he broke his left hand in the fight, was promised a title shot if he won.

"Guess what, I earned it," said Hendricks.

And welterweight Jake Ellenberger knocked out former Strikeforce champion Nate Marquardt in the first round.

Diaz came out to a chorus of boos, one man against a champion backed by thousands in the stands. He calmly walked inside the cage, his four corner men urging him on.

Then the lights dimmed and St-Pierre followed, bouncing up and down in his traditional karate garb to pulsating French-language rap. The crowd erupted.

Diaz walked over to the cage and yelled something as St-Pierre prepared to enter. It didn't seem like a hello. Montreal referee Yves Lavigne then moved over to keep a close watch on the challenger.

The place was rocking before the cage doors closed.

St-Pierre's first takedown came seconds later. Diaz looked to work a submission, but the champion controlled him, firing punches as Diaz tried to get up. A pair of elbows produced a knot on the challenger's forehead.

The crowd started chanting "Ole! Ole!" St-Pierre responded by dropping Diaz on his head, capping a dominant first round.

St-Pierre landed another takedown 40 seconds into the second round and soon had Diaz on his knees face down again, hitting him with knees and punches. Diaz's face was showing damage.

Diaz tried to get in the champ's face as the round ended.

Diaz went down again in the third, after eating some punches. When Diaz got back up, he fired some leg kicks and scored with some jabs. Then St-Pierre dumped him, battering him on the ground.

Diaz flicked a punch after the bell at St-Pierre, whose face was bloodied.

Both men looked tired in the fourth, but St-Pierre scored another takedown and Diaz soon had the champion clamped to him again.

The two clinched in the fifth before Diaz fell attempting a kick. St-Pierre jumped on him and Diaz was again face down on the mat. The fight finished fittingly with St-Pierre on top and the crowd roaring.

The two shook hands, hugged and Diaz raised St-Pierre's hand.

The champion came into Saturday's fight on a 10-bout win streak. And needing just three rounds to erase Randy Couture's UFC record of 44 championship rounds fought.

It was St-Pierre's 13th championship fight, second only to the retired Couture (15).

Condit was initially due to face Rory MacDonald but the Montreal fighter had to pull out with a neck injury. That forced a reshuffle of the welterweight bouts with Hendricks moved to face Condit and Marquardt brought in to take on Ellenberger.

Ellenberger (29-6) made short work of Marquardt (35-12-2), knocking him down with a left-right and then hurting him with another. Marquardt did not seem to like the stoppage by Philippe Chartier, at 3:00, but he was dazed and vulnerable.
